Government faces Supreme Court ire for not going ahead with CEE for MBBS

NEW DELHI: Government today faced the ire of the Supreme Court for expressing its unwillingness to go ahead with the first-ever common National Eligibility-cum-Entrance Test (NEET) for all MBBS courses across the country.

The apex court said it will "not become party" to the decision of the government which sought deferment of the common entrance examination by one year to 2013.

"Either we will reject your application or you withdraw your application. Whatever you want to do you can do but we are not going to be party to your decision," a bench comprising justices H L Dattu and C K Prasad said.

"All this order (for the single entrance test) was passed after hearing you (centre). You said draft rules and regulations were in place for implementing it in the academic year 2012-13," the bench said.

"This court will not be a party (to your decision). We will not be party to all these regulations. Why will we be party to it (for deferring the CEE). Why are you bringing this court in this matter. You better start and withdraw this application," the bench said.

The Ministry of Health and Family Welfare had moved an application seeking court's order in this regard saying that some state governments have expressed reservation to switch over to the new system and wanted students to get acquainted with the syllabus prescribed by the Medical Council of India.

It was also reported that the West Bengal Government had expressed preference to continue with the Joint Entrance Examination Board for all colleges in the state and Chief Minister Mamata Banerjee had written a letter to the health minister on August 11.

The apex court in March this year had cleared the deck for the Centre and the Medical Council of India (MCI) to hold a common entrance test for the MBBS and PG courses despite objections raised by some state governments and first among them was Tamil Nadu.

Dear Sir

           West Bengal Joint Entrance Board is going to publish the notification for WBJEE-2012 very soon. I appeal to consider few matters in this regard :

1. It would not be suitable to maintain the cut-off marks principle in WBJEE Medical as recently there an interim order has been passed by Division Bench of Guahati High Court about this on dated 21/09/2011. A part of the order is given below :

42. Because of what have been discussed and pointed out above,

What  becomes  clear,  and  we  do  hold,  is  that  the  MCI  Regulation

5(5)(ii)  is  in  violation  of  Article  14,  which  guarantees  equality  of

treatment,  so  far  as  Regulation  5(5)(ii)  requires  securing  of  40%

marks   in   the   combined   competitive   examination   as   the   basis   for

selection for admission into the MBBS course.

 

2. Time has come to withdraw existing negative marking system in WBJEE. There is no other way without it. If not, to fill up all Schedule Tribe (ST) quota seats in Medical, JEE board has to consider even – 40 (minus forty) marks for them for ranking. If anyone appear in the Court, the WBJEE board will be bound to give them rank in such abnormal negative marks. 

3. Now only 150 days remain for entrance examination. There is doubtful whispering from board office which has also been published in “The Times of India” & others that WBJEE Board is going to change the existing question pattern (80 % MCQ and 20% non- MCQ). If it is done some examinees will get advantage and other many will suffer. From previous years record it is seen that in medical ranking about 30-40 students hold same number. So even a negligible difference of obtained marks of students there will be vast alteration of ranking by the students. Students and their guardians are reacting badly. Why the prosperous Govt. of “Maa, Mati, Manoosh” will take the responsibility ?

I do appeal that all these aspects of WBJEE should be considered, tested and verified before notification.

Sub - off-line/on - line examination centres

Dear Sir,

I appeal that all these aspects of AIEEE - 2012 should be considered about off-line/on - line examination centres.

 1. Notification for AIEEE – 2012 has already been done by CBSE.  This is the first time when all off-line examination centres of AIEEE have been removed from metro & other many big cities. The students from nearest districts of those metro / big cities will have to sit for on-line exam only – because no other option remains with them. Existing off-line centres are too far for their ability to reach. E.g. in West Bengal there are only two off-line centres for AIEEE-2012, one at Durgapur & other at Siliguri. Further, those students are not used to operate even the computer, as in their time from class I to XII, computer subject was not mandatory in many state board curriculum.

2. There are so many hazards for on-line examination like :

 i) Computer server may be down at time of examination.

ii) Examinees are bound to answer serially, no further chance for answering harder or critical questions later when he/she can memorize that.

Sub :  An appeal to consider different provisions of NEET before its implementation

With due respect, I want to draw your kind attention for as follows:

 1.  In National Eligibility-cum-Entrance Test (NEET) – Undergraduate Medical Entrance there is a common syllabus, single exam, one result. Medical Council of India (MCI) has agreed to reserve 85% seats as State Quota on demand of different State Govts at MCI meeting. This goes against efficiency and real talents – violating constitutional rights.

In West Bengal, Tamil Nadu and some other states there were District-wise reservation in middle of sixty’s for admission to a medical college which was struck down by Supreme Court on the ground that the object of the selection of candidates for the admission is to select the best possible talent from the entire state, having regards to efficiency required for medical profession. It is against Article 14 of Indian Constitution. Observation of Supreme Court are same for about two dozen of same type cases up to 2011.

So State-wise reservation of 85% NEET – UG medical seats for admission in a medical college through NEET is against Article 14 of Constitution.

When there will be no state-wise reservation, in educationally backward states majority of seats in medical will be filled up by the brilliant students of other states. Provincialism will create a new problem - all over the country there will be a problem of law and order.

2. Notification for AIEEE – 2012 has already been published by CBSE. All off-line exam centres from metro & many other big cities have been cancelled. The students from nearest districts of those cities will have to sit for on-line exam only –it is not expected. Those students are not used to operate computer, as in their time from class I to XII, computer subject was not mandatory in their state board curriculum. CBSE board members have no idea about remote villagers. There reside many brilliant and talented students also.

Leak out of question paper in any exam conducted by CBSE board is day-to-day phenomenon. In last year AIEEE question paper was leaked out. More than fifty thousand examinees failed to sit the examination for mismanagement.    

Thus, CBSE board has no minimum credentiality to conduct such a vital & prestigious medical entrance exam throughout India. 

3. The Board which is taking CBSE-PMT exam. for last 24 years and failed to establish even an office in different States to meet up grievances of the students or people couldn’t claim themselves to be a credential organization.

4. CBSE board expresses their inability to conduct the NEET exam in multi-language. It is stated that NEET examination will be conducted either by Hindi or English language which is not fair for the others regional languages. Most of the students read science subjects in their own regional languages. To search real talent and also for culture & development of regional languages question paper of NEET must be in Multilanguage. Otherwise Govt. model schools of different states which are run by regional languages, will come at a close end due to lack of students. RAIL, BANK etc conduct their exams. in Multilanguage to establish equality and justice for all.

5. The concept that exam burden for several medical entrances will be relieved through NEET, is not true. AIIMS, AFMC, PGIMER, JIPMER (Puducherry) & medical colleges of Jammu and Kashmir (under Article 370) etc. are out of NEET.

6. Central Govt. claimed that they didn’t granted permission to MCI to conduct NEET. On 27/12/2010 MCI had published a Gazette notification that they will conduct the NEET. Mr. Gopal Subramanium, learned Solicitor General appeared before Hon’ble Supreme Court on 18/02/2011 in favour of the Ministry of Health and Family Welfare has submitted that no approval was granted by the Ministry in favour of notification.

 Further on 04/11/2011, MCI published final Syllabus for NEET-UG in Physics, Chemistry, Biology (Higher Secondary Stage). This syllabus is for National Eligibility-cum-Entrance Test (NEET) for admission to MBBS courses all over the country. MCI can never publish final Syllabus for NEET-UG without prior approval and Gazette  notification of Central Govt. This is also a part of admission procedure to MBBS. This is against law.

         I do appeal that all these aspects of NEET should be considered, tested and verified before its implementations.

CET for MBBS The Supreme Court, in Simran Jain case, has accepted the proposal of the Medical Council of India (MCI) to conduct common entrance test viz. National Eligibility and Entrance Test (NEET) for admission to Under Graduate (UG) and Post Graduate (PG) medical courses in the country and directed the Council to take such steps as are necessary to implement the NEET. Accordingly, the Central Government has constituted a Committee to finalize the modalities for implementation of NEET. Once implemented, the NEET would be applicable to all medical colleges which come under the ambit of MCI, including for approximately 54 per cent of MBBS seats available in private medical colleges.

Further, Central Board of Secondary Education, which is the agency for conducting NEET for UG, has constituted an Advisory Committee consisting of Members from all States to address the issues of admission processes prevalent in various States like reservation, medium of test, etc.

This information was laid by Union Minister of Health and Family Welfare Shri Ghulam Nabi Azad in Rajya Sabha today.

Much to the relief of students aspiring to become doctors, the central government has agreed, in principle, to postpone the introduction of the National Eligibility-cum-Entrance Test (NEET) for admissions to medical colleges by two years.

The official orders to this effect are likely to be issued in a day or two.

According to official sources, Union health minister Ghulam Nabi Azad confirmed the decision to chief minister N Kiran Kumar Reddy over phone on Friday.

The chief minister had urged the Centre to exempt Andhra Pradesh from NEET for at least two years in view of the various difficulties the students of the state would have to face if NEET were to take effect from the next academic year.

“The Union minister agreed in principle to postpone the examination by two years. However, it is unclear whether only students from Andhra Pradesh are exempted or the government has decided to postpone the examination all over the country. A clear picture will emerge in a couple of days after official orders are released,” said sources in the chief minister’s office.

The NEET was proposed as a single national-level entrance examination for admission to all medical colleges in the country.
The central government’s announcement over implementation of NEET from next academic year sent shock waves causing much anxiety to students, parents and academicians as the state syllabus is different from the central syllabus.
If implemented from next academic year, students from the state are likely to be affected severely as the NEET examination will be based on the central syllabus.
Considering the concerns of students, the chief minister took up the issue with the Union health minister seeking time for revamping the state syllabus so that students from Andhra Pradesh can compete with CBSE students on an equal footing.
He requested the union government to postpone the examination to make required amendments to certain educational Acts and also revise the curricula of school and Intermediate education on a par with the central syllabus.

Srinagar, Nov 16: The Supreme Court has exempted Jammu and Kashmir from Medical Council of India directive for medical entrance at All India Level in state-run colleges after government had invoked constitutional rights under Article 370, officials disclosed Wednesday.

 They said the breather from the Apex Court followed the suggestions sought by it from different states including Jammu and Kashmir on the matter after the MCI had for the first time announced to hold an All-India level examination for admission to medical courses across the country early next year.
 In its response, sources said JK had cited constitutional protection under Article 370 maintaining that education is its jurisdiction. “In its directions on the matter, the Supreme Court has exempted Jammu and Kashmir from following the (MCI) policy,” said Secretary, Law, G H Tantray.
 Though the MCI has already issued notice announcing conduct of the examination, an official at the Board of Professional Entrance Examinations- (BOPEE)  a state body which conducts the medical and other professional examinations - said it will have no bearing on the state.
 The official, wishing anonymity, said the MCI- an umbrella body of all medical colleges from different states- will continue to ensure maintenance of standards of the institutions by J&K.
 Officials said due to the protection provided by the J&K Constitution, Jammu and Kashmir does not follow many MCI guidelines for conduct of examinations and admission to different courses.
 Citing example, officials said while MCI recognizes only three categories, SC/ST/OBC, for entrances examinations, JK approves five to seven categories.
 Earlier this week, government had made it clear that medical entrance 2012-13 shall not be covered under MCI for allotment of seats in the medical colleges in Jammu and Kashmir.
 Minister for Medical Education, RS Chib, had said that MCI had tried to approach State with the intention to cover all its medical colleges for admission under their admission guidelines. However they were specifically informed that the same will not be allowed under the provision of special laws of the state.
 Officials said in fact BOPEE has already announced to conduct post graduate and undergraduate medical examination in February and June respectively.
Last year more than 22000 candidates had appeared in MBBS entrance examination for which the results were announced in record four days.
“We are performing our job smoothly,” said a BOPEE official.

42.           Because of what have been discussed and pointed out above,

 

What  becomes  clear,  and  we  do  hold,  is  that  the  MCI  Regulation

 

5(5)(ii)  is  in  violation  of  Article  14,  which  guarantees  equality  of

 

treatment,  so  far  as  Regulation  5(5)(ii)  requires  securing  of  40%

 

marks   in   the   combined   competitive   examination   as   the   basis   for

 

      selection for admission into the MBBS course.   

 

 National Policy

Language being the most important medium of communication and education, their development occupies and important place in the National Policy on Education and Programme of Action. Therefore, promotion and development of Hindi and other 22 languages listed in the schedule VIII of the Constitution
